My nominated occupation has been removed from the lists as an eligible occupation. What does this mean for my current 457 visa?

Your current 457 visa is unaffected. You can remain in Australia employed in your nominated role until the expiry of your current 457 without impact.

My current 457 visa is close to expiring. What is the impact?

If your occupation has been removed from the lists of eligible occupations for the 457 / TSS visa, you should reach out to Deloitte with your current position description and ask whether your role can be categorised into an occupation that appears on the list.

If your role cannot be re-categorised, you will not be eligible to apply for a further 457 / TSS visa.

Please note, if your role can be re-categorised, this may have impacts on your eligibility for permanent residence under the Temporary Residence Transition Stream.

I am up for promotion or a new role. What is the impact?

Before accepting any new role, this should be assessed in full to confirm whether the new role will result in an occupation change. If the new role ca n be categorised into an occupation that is eligible for the 457 / TSS visa, then you may proceed.

Please note, a change in occupation may impact your eligibility for permanent residence. You should reach out to Deloitte to assess your situation and advise accordingly.

I am seeking employment with a new sponsor. What is the impact?

If your nominated occupation has been removed from the list of eligible occupations, you will not be eligible to transfer your 457 sponsorship.

If you have been offered a different role and the new occupation appears on either the Short-Term Occupation List (STSOL) or Medium and Long-Term Strategic Skills List (MLTSSL), you may be eligible to apply.

For occupations appearing on the STSOL, you are eligible to apply for a two year 457 / TSS visa with one further two year renewal. Occupations appearing on the MLTSSL are eligible to apply for multiple four year 457 / TSS visa renewals.

I am thinking of applying for permanent residence. What are my options?

If your nominated occupation has been removed from the list of eligible occupations, you may still be eligible to apply under the Temporary Residence Transition Stream (the “two year” pathway). Under this stream, you must have been employed in your nominated role as the holder of a 457 visa sponsored by UWA for at least two years out of the last three years. If you are over the age of 50 you will need to have spent 4 years on a 457 visa with UWA, and further additional requirements apply.

You will not be eligible to apply for permanent residence after March 2018.
